AAT DECISION
- STEVEN HAMMOND AND ARCHERFIELD AIRPORT CORPORATION PTY LTD (AAC) The Administrative Appeals Tribunal (AAT) has now handed down its
decision in the above matter. The full text ot the decision is made available on
the Chambers website at download report (pdf- 59kb) and we encourage you to read
it. The decision requires Archerfield Airport Corporation Pty Ltd to issue to Mr
Hammond an Authority to Drive Airside (ADA) and and Authority to use Airside (AUA)
however this is made subject to the condition that he hold a commercial license.
The important aspects of this decision in so far as the Chamber and our members
are concerned are:
The 1998 Handbook is the relevant
handbook in this case under the regulations
Airside Vehicle Permits are only
valid for 24 months (as is given effect to by the 1998 Handbook)
Archerfield Airport Corporation
was not aware that some of its decisions were capable of being reviewed by
the AAT
Advise about entitlement to have
a decision reviewed was not provided by AAC to Mr Hammond
The decision that was actually
reviewed by the AAT was the decision in 2006 made by AAC to refuse access
and that it amounted to a decision by AAC to withdraw access
Your Chamber considers that the only currently valid handbook is
the 1998 Handbook. Therefore members who have leases on the airfield and have
been refused access and previously had access may like to complete the forms of
the 1998 handbook instead of the 2005 Handbook in making a new application.

Should AAC refuse to issue access to a member who has completed
the 1998 handbook forms, AACC Inc will give consideration to also assist in
bringing this matter before the Administrative Appeals Tribunal.
